Important Update for Pro-Lifers on the SCOTUS and the MS Dobbs vs Jackson Supreme court case!
Here’s a quick recap of the events going on this week with the SCOTUS and the MS Dobbs vs Jackson Supreme court case!
The Supreme Court is having oral arguments this week concerning the Mississippi Pro-Life case Dobbs v. Jackson Women’s Health Organization. Most political pundits and those in the Pro-Life community are in agreement that the decision coming out of the SCOTUS will likely have a strong bearing on what the future holds for Roe v. Wade, and some see the decision as reducing the influence of R v. W on future Pro-Life cases, swaying decisions FOR LIFE!
Let’s take a quick moment to review what’s happening!
- How will SCOTUS’ ruling impact those of us that are Pro-Life in Georgia?
The Dobbs V. Jackson Women’s Health Organization case is a result of the 2018 Mississippi “Gestational Age Act” that prohibits most abortions after 15 weeks. This case was struck down by a lower court, with the court stating the case violated Roe v. Wade’s precedent and intent, preventing states from prohibiting abortions pre-viability.
The MS case is focused on one important legal question that SCOTUS has yet been able to answer or give any direction:
All pre-viability abortion restrictions are unconstitutional. Viability is the point when a baby is developed enough to likely survive outside of the womb - currently somewhere around 21 weeks gestation.
The Mississippi case presents in its verbiage, that because their law only prohibits some pre-viability abortions, it is only a “pre-viability restriction on abortion” and poses no undue burdens on a woman’s right to choose, which would put their state on par with 47 out of 50 European nations (Those nations limit abortion to 15 weeks. Legally not allowed to abort post-15 weeks)
After the oral arguments on December 1st for the MS case, the case will then be deliberated by the Justices, in addition to all of the other cases they will hear during this current term. A ruling on the case, more than likely, will not occur until the latter part of June of 2022. The reason being for this date, is that there are numerous other cases that will be reviewed, and most pundits believe the abortion leaning judges on the court will put off their decision till as late as possible, in hopes of deterring the pro-life judges and pro-life established organizations. Most believe the court will not overturn Roe v. Wade, only because this case may not have the legal footing to result in such a victory.
- HERE’S WHAT A FAVORABLE PRO-LIFE DECISION WILL DO!
It’s our prayer at WGRTL, that the Georgia Heartbeat Bill (without exceptions for rape and incest) will pose a new legal question that the Supreme Court will be asked to answer:
Now that state’s will have a strong SCOTUS ruling to protect life in the womb pre-viability, does this now grant the state the opportunity to place “Personhood Rights” to that child in the womb and effectively ban abortion? Personhood has become our new “Victory-March Song” for WGRTL and the Pro-Life movement, and it’s the Personhood connection to the US Constitution that will end Roe once and for all.
Should SCOTUS rule in favor of MS in the Dobbs case, and when the 11th Circuit Court upholds the court’s decision, the issue of abortion’s legality will become the state’s authority, meaning each state will have the right to decide for itself whether abortion is legal in their respective state.
- What can we, as Pro-Life Georgians, do to help the cause?
- ➡ PRAY: James 5:16 “The effectual fervent prayer of a righteous man availeth much” Pray for the Justices on the Supreme Court during the Dobbs oral arguments. I’m continually reminded of the quote from Dietrich Bonhoeffer, Lutheran Pastor, Evangelist and Anti-Nazi dissident:
“Silence in the face of evil is in itself evil;
God will not hold us guiltless;
Not to speak is to speak;
Not to act is to act!”
